An audio CD has been officially incorporated as an exhibit in the trial against the Member of Parliament for Bahi, (CCM), Mr Omary Ahmed Badwell (43), who is charged at the Kisutu Resident Magistrate’s Court in Dar es Salaam with soliciting and receiving bribes.
The CD allegedly contains some conversations between the MP and the complainant in the matter. The case came for mention on Monday before Senior Resident Magistrate Hellen Riwa and parties were informed that the case file that had been taken to the High Court had been handed back.
In previous court sessions, the court had admitted the CD as part of the exhibits in the matter, but the advocate for the lawmaker, Mr Mpale Mpoki, took the matter to the High Court to challenge its admissibility. However, the higher court turned down the contention.
Following the return of the court file, hearing of the corruption case will proceed on a date to be set later. The magistrate adjourned the case for another mention on February 6, pending finalization of other logistics.
It is alleged that the MP from the ruling party and a member of the Parliamentary Local Authority Accounts Committee (LAAC), solicited a sum of 8m/- from Ms Sipora Liana, who is District Executive Director (DED) for Mkuranga.
Being a member of a parliamentary oversight committee, the legislator allegedly asked for the bribe so as to lobby fellow committee members to give a clean bill of health to the council’s budget report.
The court heard that the MP allegedly received one million shillings from Ms Liana at Peacock Hotel in Dar es Salaam on June 2, 2012.
Prosecutors from the Prevention and Combating of Corruption Bureau (PCCB) alleged further that the accused committed the offence between May 30 and June 2, 2012.
