Lawyers for Bongo Movie Actress, Elizabeth Michael Kimemeta, alias Lulu, have filed an application before the High Court, requesting their client to be granted bail.
The application has been set for hearing on January 25, before Judge Zainab Mruke.
“This Honourable Court be pleased to grant bail to the applicant (Lulu) with or without sureties pending the hearing and conclusive determination of her case,” reads the application signed by the lawyers, Peter Kibatala, Kennedy Fungamtama and Fulgence Massawe.
The application has been filed under certificate of urgency on grounds that the applicant has been in remand custody for more than seven months and that the offence she stands charged is bailable.
Court documents show that Lulu is charged with murdering without intention a former local movie star, Steven Kanumba, on April 7, 2012, at Sinza Vatican. Kanumba was said to have been embroiled in a brawl with his girlfriend (Lulu) at his home in Sinza.
In his affidavit to support the application, one of the lawyers (Kibatala) stated that Lulu, who is currently remanded at Segerea Prison in the city awaiting trial, faces charges of manslaughter in Criminal Case No.
125 of 2012 which is pending before the court. He stated that committal proceedings in respect of the charge instituted at the Kisutu Resident Magistrate’s Court, were completed on December 21, 2012, and Resident Magistrate, Christine Mbando, thereafter, committed the applicant to the High Court for trial.
“It is my understanding as the applicant’s advocate that if admitted to bail, (she) is willing and able to fulfil all bail conditions which this Honourable Court may deem just to impose,” the advocate further stated in his affidavit.
To his understanding, Advocate Kibatala explained that he has had ample opportunity to be acquainted with the applicant as well as her family, and on that basis he was certain that Lulu was a person of “good character, reliable and is under the care of her parents”.
Lulu’s parents, according to the counsel, were ready to ensure fulfilment of the conditions and to make sure that their daughter appears in court as and when required for the trial or for any other purpose.
“The applicant is a public figure and resident of Dar es Salaam, hence easy monitoring to ensure fulfilment of the bail conditions. I am also ready, as the applicant’s advocate, to ensure that she duly fulfils all bail conditions, and to appear in court as and when required,” he explained.
In addition, Mr Kibatala assured the court that Lulu has reliable sureties who are ready to appear before the court (to stand as sureties) on her behalf.
