MAKUENI, KENYA: Two Makueni County voters have moved to the court to challenge the election of Mutula Kilonzo junior as Makueni County senator.
Alphonse Mulandi Wolile and Muthini Mwenga have filled their case with the Machakos High court arguing that Mutula junior was not validly elected.
Through their lawyer B.M.Musyoki, the petitioners have raised constitutional issues regarding the nomination and clearance of the Wiper senator for the July 26 by election.
They cited the pasting of Mutula’s details on the ballot paper terming it a violation of the constitution adding the process was manipulated to favor one candidate.
They argued Mutula junior’s details were conspicuously embossed to attract the attention of the voters.
“The ballot paper must be printed with equality so as not to disenfranchise or favor one candidate,” added the petitioners.
The High Court Registrar Rose Makungu confirmed Mutula junior had already entered appearance through Mutula Kilonzo and company advocates.
She said the matter will be mentioned before Justice David Manjanja on September 17th for direction.
Meanwhile Ms Makungu said the much awaited ruling of the petition challenging the election of Dr.Alfred Mutua by his competitor Ms Wavinya Ndeti will be delivered on September 17th.
